Practice Areas

At Naik | Law & Advocacy Group, we provide the following legal services.

Breach of Contract

I provide decisive and strategic counsel to businesses and individuals on "both sides of the v." -- whether you need to bring a claim or defend against one.

In addition to discussing the obvious (contract validity and enforceability, likely defenses and counterclaims, and damages exposure / potential recovery), we will talk about cost-benefit and timing considerations, which will allow you to make an informed business decision -- to litigate, negotiate, or walk away.

I oftentimes help businesses challenge overreaching demands and help clients with claims arising from contract breakdowns, such as defamation, non-compete agreements, merchant cash advance agreements, and fraud.

I implement a business-first litigation strategy, for which you can expect:

  • Early motion practice to shape the playing field
  • Targeted discovery -- no fishing expeditions
  • Candid settlement analysis at every phase
  • Thoroughness and readiness that drives meaningful negotiation

Contractual Issues (without a contract)

I can help you with business conflicts without a governing contract, such as:

  • Oral or handshake deals that have unraveled
  • Unjust enrichment, promissory estoppel, and implied contracts
  • Deals among close friends, family members, or partners that have gone sideways

Partnership and Business Disputes

Tension among partners and inside a company can be as stressful as competition outside of it. I help owners, executives, and entrepreneurs navigate high-stakes business conflicts -- both with and without agreements.

I can help you with:

  • Partnership and LLC member disputes
  • Claims for breach of fiduciary duty, diversion of corporate opportunities, and unequal distributions
  • Corporate divorce

And not every dispute belongs in a courtroom. When the relationship still has value, we can discuss negotiating, mediation, or other conflict resolution options.

Merchant Cash Advance Defense

With thanks to my former colleagues, I can help aggressively defend you and your company against plaintiffs that knowingly preyed on your struggling business and failed to work with you when you could not make subsequent fixed payments due to the ebbs and flows of your company's income.

Oral Arguments (including appeals)

Many of my colleagues prefer legal research and writing and leaving the oral advocacy to someone else. I thrive on answering questions from "a hot bench" and advocating for my clients the best I can.

I have successfully argued in the following courts, and would be happy to discuss covering an oral argument for you.

  • Third Circuit Court of Appeals (audio available upon request)
  • Fourth Department of New York (video available upon request)
  • Supreme Court in New York, Brooklyn, and Nassau counties

Appeals

Having a fresh set of eyes look at your trial record can be very beneficial. I have successfully won appeals at the federal and state level after finding ways to convincingly emphasize facts that the trial court did not focus on. Whether you need advice at the briefing or oral argument stage, I can help you appeal a decision that you are not happy with.

Personal Injury / Torts

As I have done over the last year, I will consider helping plaintiffs bring serious personal injury claims, such as wrongful death, or lawsuits arising out of motor vehicle accidents that lead to serious injuries.

Government Investigations

I help individuals and businesses navigate being contacted by a government agency in relation to an indictment, a subpoena, a voluntary document request, or a request for an interview.

We are ready to help you.

Complex and high-stakes litigation Lawyer

About Naik | Law & Advocacy Group

When I was a first-year law student preparing for on campus interviews for my first job as a lawyer out of law school, I didn't understand why there weren't many firms that were profitable, had a stellar reputation, and worked on public interest litigation. My goal was always to get the best training at a top law firm in New York City, and eventually open up my own shop that would check all three boxes. Launching this law firm in June 2025 is me taking the first step toward that goal.

Complex and high-stakes litigation Legal Team

Meet the team

I take pride in sizing up a case and digging into its facts and the law to ensure that clients have every conceivable chance of a favorable outcome regardless of the opponent. Litigation may not always be the best option for some clients, in which case I strive to help them avoid it. I am always prepared, though, to move forward with litigation should it ever become necessary. I come up with a strategy to win the whole case and not just the next step in it. I love going to trial and arguing in court and I understand the importance of bringing the same energy to weeding through complex discovery and drafting efficient motions. I honed my craft at Latham & Watkins LLP and Kaplan Hecker & Fink LLP in New York City and look forward to offering those same skillsets to clients of all shapes and sizes at lower rates.

I have represented plaintiffs and defendants in a wide variety of cases, including at trial. I have also represented defendants who are targets of government investigations and conducted internal investigations on behalf of various Boards of Directors. My experience includes securing a $1.04 billion bench trial judgment for UBS in a breach of contract dispute against hedge funds affiliated with Highland Capital Management. I also represented Virgin Media, Inc. in a civil suit filed in New Jersey Superior Court. The trial team obtained summary judgment disposing of $1 billion in claims for lost profits under an indemnity agreement. The remaining equitable claims were settled on favorable terms during trial.

I have also represented Mary Trump in her appeal against Donald Trump, Maryanne Trump Barry, and the estate of Robert S. Trump. I have also represented several professional golfers and agents who were subpoenaed as nonparty witnesses in connection with LIV Golf’s lawsuit against the PGA Tour alleging violations of federal antitrust law and further represented professional golfers in a similar state court action. I have also written amicus briefs filed on behalf of a range of clients, including former White House and Department of Justice officials opposing President Trump’s claims of presidential immunity relating to the events of January 6, 2021 and public interest organizations opposing a state practice of requiring the filing of individual actions to seek the return of illegitimately obtained funds.

I also briefed and argued a successful immigration appeal as a third-year associate before the Third Circuit. A month after my argument, the Court granted my client’s petition for review. In doing so, the Court also identified the lower courts’ actions that violated my client’s due process rights. Latham & Watkins LLP awarded me with a Pro Bono Star award in 2020 for my success in this case.

My public speaking appearances include guest lecturing at University of Michigan Law School and Hunter College, providing the opening remarks at the 2021 National Asian Pacific American Bar Association Conference in Washington, DC, and moderating and speaking on several panels, including at Duke University Law School, New York University School of Law, Columbia Law School, and Cardozo School of Law.

I would be remiss if I did not mention the success of my Batavia High School mock trial team, coached by former Genesee County District Attorney Larry Friedman. High school mock trial is where my love for trials, the application of the rules of evidence, and winning against formidable opponents began.

Now, for the boring stuff. I graduated from Brown University in 2011 with a B.A. in International relations. I then worked as a litigation legal assistant and paralegal at Cravath, Swaine & Moore LLP until attending Michigan Law School (Go Blue!) and graduating cum laude. There, I was the Executive Development Editor of Michigan Law Review Vol. 115 and earned Honors in Legal Practice.

I have been recognized as a New York Metro Rising Star by Super Lawyers every year since 2020. I am admitted to practice in New York, the U.S. Courts of Appeals for the Third and D.C. Circuits, and the U.S. District Courts for the Southern, Eastern, Northern, and Western Districts of New York. I have also been admitted pro hac vice in several jurisdictions throughout the country, including Texas, Florida, and DC.

In my free time, I enjoy reading fiction, watching live theatre, being shocked by how I can still sing every word to albums I incessantly listened to and therefore memorized decades ago, being the Membership Director of the Asian American Bar Association of New York, and being on various amicus committees at the local and national levels.
